    <description>The Court on 29.03.2012 in cases C-504/09 and C-505/09 confirmed that the Commission exceeded its powers by imposing on Poland and Estonia a ceiling on greenhouse gas emission allowances.</description>
    <content:encoded xmlns:content="http://purl.org/rss/1.0/modules/content/"><![CDATA[<p>The Directive 2003/87/ES establishing a scheme for greenhouse gas emission allowance provided that, for each five year period, each Member State was to develop a national allocation plan (NAP) stating the total quantity of allowances that it intended to allocate for that period and how it proposed to allocate them.</p>
<p>If the plan was incompatible with the criteria laid down in the Directive, the Commission could reject the NAP or any aspect thereof.</p>
<p>The Commision is not authorized to impose on Member State an upper limit of greenhouse gas emission allowances.</p>

<p>The Carinthian-born Larissa Aigner (27) after her study and judicial year was employed at the Federal Ministry of Health. Since March 2012, she supports the team of NH Attorneys in Vienna in the areas of enviromental law and public commercial law.</p>
<p>Magdalena Gollé (29) from Vienna worked after her study first at Federal Ministry for Transport, Innovation and Technology as well at legal editorial office of HELP.gv.at and USP.gv.at. After completing her legal practice, she supports since March 2012 in Vienna the office of NH Attorneys and she is working int he fields of enviromental law and public commercial law.</p>
